Reporting Copyright Infringements

Before reporting a copyright infringement claim, please contact the person who posted it. You may be able to resolve the issue without contacting ISEN.

What Happens wWen ISEN Acts On A Claim That The Artist Has Infringed Someone's Copyright? Is It Possible To File A Counter Notice?

When ISEN receives a report claiming copyright infringement, ISEN may immediately remove that content from the website without contacting you first.

If ISEN removes your content due to a copyright claim, you will receive a warning with the contact information of the person or a company who submitted the report. You can follow up with them directly if you disagree with the claim.

If the content was removed under the notice and counter-notice procedures of the United States Digital Millennium Copyright Act (DMCA), you will be able to file a DMCA counter-notification.

Please make sure that all the artwork you register does not violate or infringe the rights of others.

How Does ISEN Process DMCA Counter-Notifications?

ISEN complies with the notice and takedown procedures defined in section 512(c) of the United States Digital Millennium Copyright Act ("DMCA"), which applies to content reported and removed for infringing United States copyrights.

If your artwork was removed under the notice and counter-notice procedures of the DMCA, you will receive instructions about the counter-notification process, including how to file a counter-notification, in the warning that ISEN sends you.

When ISEN receives an effective DMCA counter-notification, it will be promptly forwarded it to the reporting party. If the reporting party does not notify ISEN that they have filed an action seeking a court order to restrain you from engaging in infringing activity on ISEN related to the material in question within 10-14 business days, ISEN will promptly restore eligible content under the DMCA.

How Can I report A Claim Of Copyright Infringement?

Please keep in mind that submitting a copyright infringement is a serious matter that brings legal action. Therefore, before submitting a copyright claim, it is strongly advised that you contact the person who posted it. There is a chance you can resolve this issue by bringing it to their attention without involving ISEN.

If you're not sure whether the content you're reporting is infringing your legal rights, you may want to seek legal guidance. Keep in mind that submitting intentionally misleading reports of infringement may be punishable under the Digital Millennium Copyright Act (DMCA) in the United States or similar laws in other countries.

What Information Should I Include When Submitting A Claim To ISEN Regarding Infringement Of My Copyright?

If you believe that somebody is using your copyrighted work without your permission, the fastest way is to resolve it is to contact us.

Please include the following information:

  • Your contact information including full name, mailing address and phone number. Please note that ISEN provides this information to the person who posted the reported content.
  • Description of the copyrighted work
  • URL to the allegedly infringing content
  • A declaration that
    1. You have a good faith belief that use of the copyrighted content described above, in the manner you have complained of, is not authorized by the copyright owner, its agent, or the law,
    2. The information in your notice is accurate, and
    3. You declare, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed.
  • Your electronic signature or physical signature.

What Information Do You Provide To A User Whose Content Gets Removed Due To A Copyright Claim?

When ISEN receives copyright claims through the online form and removes the content in question, the user receives the following information:

  • Rights holder's name
  • Email address provided by the reporting party
  • Description of the rights holder's copyrighted work
  • Description of the removed content

For any content that was removed under the notice and counter-notice procedures of the United States Digital Millennium Copyright Act (DMCA), ISEN will include information about how to submit a counter-notification under the DMCA.

Can I Report Infringement Of Another Party's Copyright?

Only the copyright owner or his representative can send a copyright claim.

What Happens After I Submit A Copyright Infringement Claim?

ISEN will process the claim, which may result in removing the alleged content from the website.

In case the content gets removed, a person who posted it will receive a warning them about it. The party that posted the content will also receive your contact information.
